21 Dec USCIS Issues Guidance on TN Nonimmigrant Status for Economists
USCIS recently issued a Policy Memorandum (PM) clarifying the TN definition of “economists.” The PM states that all applicants for TN work authorization under the North American Free Trade Agreement (NAFTA) Economist category “must engage in activities consistent with the profession of economist. Activities that constitute a broad range of other professions related to economics, such as activity performed by financial analysts, market research analysts, and marketing specialists do not qualify for TN status.”
This PM is binding on all USCIS employees and is effective immediately. In determining TN eligibility, an employee’s job duties, rather than job title, will be dispositive in USCIS determinations. As a result, TN Economist employees must be prepared to answer detailed questions relating to the position’s duties.
